Following the sentence of the Provincial Court and the criminal cassation appeal against the breach in errors of form lodged by the lawyer Constantino Ndong Andeme, representing Gabriel Nse Obiang Obono, against sentence number 9/2017 of 11th April 2017 issued by the Provincial Court of Malabo in summary acts number 99/2016 at the behest of Jeronimo Osa Osa Ecoro and the PDGE political party, the Supreme Court has passed definitive sentence regarding the case.
The session of the Supreme Court of Justice confirmed on 26th October in Malabo the sentence passes by the Provincial Court, regarding the complaint for libel presented by the PDGE General Secretary, Jeronimo Osa Osa Ecoro, against the leader of the Citizens for Innovation political party.
The sentence, running to over thirty pages, covers the allegations and, with a view to the legal precepts and related provisions which are of general and pertinent application, the President of the Supreme Court of Justice has pronounced the following:
1.- That we must reject and we reject entirely the the criminal cassation appeal against the breach in errors of form lodged by the lawyer Constantino Ndong Andeme, representing Gabriel Nse Obiang Obono.
2.- We must confirm and we confirm entirely sentence number 9/2017 of 11th April 2017, passed by the Provincial Court of Malabo in the summary acts number 99/2016 regarding the offence of serious libel against Gabriel Nse Obiang Obono, prejudicing Jeronimo Osa Osa Ecoro and the PDGE political party.
3.- The costs of this process will be met by the complainant, for his recklessness and bad faith. This is our sentence, which we issue, order and sign.
